On 30th of October 2017, the Austrian Arbitration Association jointly with the University of Vienna held its semi-annual ArbAut Forum, with the participation of our partner Philipp A. Peters as discussant. The event followed the successful GAR Live Vienna, which had taken place on 20th October 2017.
On 30th of October 2017, the Austrian Arbitration Association jointly with the University of Vienna held its semi-annual ArbAut Forum, with the participation of our partner Philipp A. Peters as discussant. The event followed the successful GAR Live Vienna, which had taken place on 20th October 2017. The Forum aimed at analyzing “What was not discussed at GAR Live Vienna” in a Tylney Hall style discussion of topical issues of international arbitration.
Mr. Peters exchanged views with the panelists and the audience on whether new instruments would be required or not in order to ensure the independence and impartiality of party-appointed arbitrators. The panel also discussed the extent to which arbitrators are allowed or even required to guide a party with a view to the burden of proof and the lack or sufficiency of evidence. Following a debate on professional rules and ethics and a lively discussion on whether there exists a need for summary arbitration proceedings, the event was concluded by a rather controversial debate on the apportionment of costs, including the arbitrators’ possibility to sanction a party’s procedural behavior in their cost decisions.
