Privacy Policy

1. PERSONAL DATA

We, Konrad & Partner Rechtsanwälte GmbH, collect, process and use your personal data in compliance with data protection and civil laws and only with your consent or if retained or appointed by you for the purpose agreed with you, or otherwise, in accordance with any other legal basis under the General Data Protection Regulation (GDPR).

We only collect personal data which is necessary for the performance of our legal services or which you have made available to us voluntarily.
Personal data are all data that contain individual details about personal or factual circumstances, such as name, address, email address, phone number, date of birth, age, sex, social security number, video recordings, photos, voice recordings of individuals as well as biometrical data, such as fingerprints. Personal data may also include sensitive data, e.g. health data or data related to criminal proceedings.

2. ACCESS TO INFORMATION AND ERASURE

 

As our client or, more generally, as a data subject, you have at all times – limited by our duty of professional confidentiality as attorneys at law – the right to access your personal data stored with us, the right to obtain information about the origin and recipients of your personal data as well as the purpose of data processing, the right to data portability, the right to rectification, the right to object, the right to restrict processing as well as the right to request that data which is inaccurate and/or unlawfully processed is deleted or not provided to third parties.

We kindly ask you to notify us of future changes of your personal data.
You have the right to withdraw your consent to use your personal data at any time. You may submit your request for access, deletion, rectification, objection, and/or data portability using the contact details referred to in Section 11. Requests for data portability will be taken into account unless they require disproportionate efforts from our part.

Should you consider that our processing of your personal data is in breach of applicable data protection laws or otherwise violates your rights under data protection laws, you may submit a complaint with the competent supervisory authority. In Austria, the competent supervisory authority is the Data Protection Authority (Datenschutzbehörde).

3. DATA SECURITY

Your personal data is protected by adequate organisational and technical measures. Such measures include, but are not limited to, measures affording protection against unauthorized, unlawful or fortuitous access, processing, loss, use and manipulation.

Notwithstanding our efforts to at all times maintain an adequately high level of security, we cannot rule out that information you provide to us via the internet is not viewed and used by others.

We do not accept any liability for the disclosure of information due to errors not caused by us when data is transferred and/or third parties access data without authorization (e.g. hacking of email accounts or telephones, interception of faxes).

4. USE OF DATA

We will not process the data provided to us for any other purposes than those covered by our client-attorney-agreement or your consent or any provisions in accordance with the GDPR. This, however, does not apply to using the data provided to us for statistical purposes where it has been made anonymous.

5. TRANSFER OF DATA TO THIRD PARTIES

In order to perform our services, it may be necessary to transfer your data to third parties (e.g. opposing party, substitutes, insurance companies, service providers we are using and to whom we make the data available, etc.), courts or authorities. Your data will only be transferred in accordance with the GDPR, in particular to perform our services or based on your prior consent.

Furthermore, please be advised that by providing legal services, we regularly obtain information from third parties about you that is related to certain facts or cases.

Some of the aforementioned recipients of your personal data are located or process your personal data outside your country of residence. The level of data protection in other countries may not be the same as in Austria. However, we will only transfer your personal data to countries for which the EU Commission has decided that they provide an adequate level of data protection, or else, we will take measures to ensure that all recipients have an adequate level of data protection by adopting standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. DATA BREACH NOTIFICATIONS

We are committed to ensuring that any data loss is identified at an early stage and immediately reported to you and/or the competent supervisory authority, including any affected data categories.

7. DATA STORAGE

We will not store any data longer than is necessary to fulfil our contractual and/or legal obligations and to defend any liability claims.

8. COOKIES

This website uses “cookies” to make our offer more user-friendly, effective and secure.
A “cookie” is a small text file which we transmit via our web server to the “cookie” file of the browser on your computer‘s hard drive. This enables our website to recognise you as a user when a connection is established between our web server and your browser. “Cookies” help us establish the frequency of use and the number of visitors of our website. The content of our “cookies” is limited to only an identification number which does not identify the actual individual behind it. 

Only two types of cookies are used on this website:

•    Session cookies: These are temporary cookies that remain in your browser’s cookie file until you leave our website and are automatically deleted after that.
•    Persistent cookies: These are cookies that remain on your terminal device and allow us to recognise your browser upon your next visit.

9. GOOGLE ANALYTICS

This website uses Google Analytics, a web analytics service provided by Google, Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses "cookies" to help the website analyse user behaviour. We process your data on the basis of our prevailing legitimate interest to cost-efficiently generate easy to use website access statistics (Article 6(1)(f) GDPR).

The information generated by the cookie about your use of the website (including your IP address and the URLs of the accessed pages) will be transmitted to and stored by Google on servers in the United States. We do not store any of your personal data collected in connection with Google Analytics.
This website uses an IP anonymisation feature provided by Google Analytics. Your IP address will therefore be truncated/anonymised by Google as soon as it receives it. On our behalf, Google will use this information to evaluate your use of the website, compile reports on website activity and provide other services related to website activity and internet usage to us. Google will not associate your IP address with any other data held by Google.

10. SERVER LOG FILES

In order to optimise this website’s system performance, its user-friendliness and the usefulness of information about our services provided on this website, the website provider automatically collects and stores data in the form of server log files, which your browser automatically transfers to us. This includes your internet protocol address (IP address), browser and language settings, operating system, referrer URL, internet service provider and the date/time.
The aforementioned data is not combined with any personal data sources. We reserve the right to check such data on a later date if there are specific indications of illegal use.
