The Legal Framework for Arbitration

General Information

  • UNCITRAL Model-Law based: Yes.   

  • Legal Provisions: Russia distinguishes its regulation system between international and domestic arbitrations.

    • International commercial arbitrations are governed by the Law No. 5338-I dated 7 July 1993, as amended. 

    • Domestic arbitrations are regulated by Federal Law No. 382-FZ dated 29 December 2015, which entered into force on 1 September 2016.

Arbitral Institutions

  • International Commercial Arbitration Court at the Russian Federation Chamber of Commerce and Industry (ICAC)

  • Maritime Arbitration Commission at the Russian Federation Chamber of Commerce and Industry (MAC)

  • The St. Petersburg International Commercial Arbitration Court (SPICAC)

  • The Arbitration Centre at the Autonomous Non-Profit Organisation "Institute of Modern Arbitration" (domestic arbitrations)

  • The Arbitration Centre at the Russian Union of Industrialists and Entrepreneurs

Multilateral Conventions

  • New York Convention: Yes (ratification/accession: 24 August 1960); reservations: The Union of Soviet Socialist Republics will apply the provisions of this Convention in respect of arbitral awards made in the territories of non-contracting States only to the extent to which they grant reciprocal treatment.

  • European Convention: Yes (ratification/accession: 27 June 1962).  

  • ICSID Convention: No (signatory but not ratified).

  • Energy Charter Treaty: No (terminated its provisional application in 2009).
