The Legal Framework for Arbitration in Russian Federation

General Information

  • UNCITRAL Model-Law based: Yes.   
  • Legal Provisions:Law No 5338-I on International Commercial Arbitration (1993) as amended on 29 December 2015 and entered into force on 1 September 2016. The law applies to arbitrations started after 1 September 2016. Arbitrations started before this date are governed by the old arbitration law, which was enacted on 14 August 1993.
  • Federal Law No 382-FZ on Arbitration (abritral proceedings) in the Russian Federation, entered into force on 1 September 2016.

Multilateral Conventions

  • New York Convention: Yes (ratification/accession: 24 August 1960); reservations: reciprocity related to awards issued in the terrotories of non-contracting States.
  • European Convention: Yes (ratification/accession: 27 June 1962); reservations: none.  
  • ICSID Convention: No (signed on 16 June 1992, but not yet ratified). 
  • Energy Charter Treaty: Signed and provisionally applied until 18 October 2009 inclusive, never ratified.
