Arbitrators’ Quest – CEE and SEE mock trial 2018, 4th edition

The 4th edition of Konrad & Partners’ Arbitrators’ Quest – CEE and SEE mock trial was a huge success! On 17 May 2018, eight talented participants from seven different countries competed against each other in a mock hearing in front of the Arbitral Tribunal consisting of lawyers of Konrad & Partners.

The winner of this year’s edition is Ms Agata Zwolankiewicz, who was awarded an internship and will spend two months with the arbitration practice group at our Vienna office.

Seminar on the role of external experts and calculation of damages in the arbitration process in Ljubljana

On 7 May 2018 our associate Peter Rižnik participated at a seminar on the role of external experts and calculation of damages in the arbitration process. Peter took part in the roundtable dealing with the role of party appointed expert witnesses and tribunal appointed experts in arbitral proceedings under the rules of the Ljubljana Arbitration Centre and other institutions.

The event was organized by Deloitte Slovenia and brought together lawyers, in-house counsels, arbitrators and experts.

Enforcement of foreign arbitral awards at the Joint UNCITRAL – LAC Conference on Dispute Settlement

On 20 March 2018, our associate Peter Rižnik chaired a lively roundtable on Enforcement of foreign arbitral awards at the 2018 Joint UNCITRAL-LAC Conference on Dispute Settlement in Ljubljana, Slovenia.

Peter was joined in the panel discussion by practitioners from Albania, Austria, Croatia, Serbia, Slovenia and Switzerland, who presented and debated some of the most salient issues in the application of the 1958 New York Convention in their jurisdictions. The panelists discussed the various approaches to recognition and enforcement under the case law and the relevant domestic legislation.

The Conference gathered together more than 100 participants from 20 different countries and celebrated the sixtieth anniversary of the 1958 New York Convention as well as the ninetieth anniversary of the Ljubljana Arbitration Centre.

Peter was also part of the Organizing Committee of the Ljubljana Willem C. Vis Pre-Moot, which followed the Joint UNCITRAL-LAC Conference, on 21 March 2018.

Annual Vis Moot Reception

On 26th March 2018, Konrad & Partners together with the Scottish Arbitration Centre hosted its annual Vis Moot Reception on the occasion of the 25th Willem C. Vis International Commercial Arbitration Moot.

We welcomed at our offices more than 100 renowned practitioners from all corners of the globe and had an enjoyable evening with friends and colleagues. 

We would like to thank everyone who attended our Cocktail Reception and made this a wonderful and memorable event. 

2nd Young iCCA Mentoring Programme Reunion

It was our great honour and pleasure to host the 2nd Young ICCA Mentoring Programme Reunion, during which the ICCA Governing Board member Professor Pierre Tercier addressed the arbitrators of tomorrow. Many thanks to everyone who joined us at this wonderful event.

YIAG meets VIS 2018

On the occasion of the 25th Vis Moot Court, Konrad & Partners has the pleasure of hosting the YIAG meets VIS event, jointly organized by the Young International Arbitration Group (YIAG) and the Moot Alumni Association (MAA). The event will take place on 22nd March 2018 and is primarily aimed at moot participants and arbitration practitioners. This year’s topics refer to Challenges of Arbitrators and Third Party Funding. Our senior associate Franziska Mensdorff-Pouilly will be participating in the panel discussion dedicated to Challenges of Arbitrators.

Vienna Arbitration Days 2018

Vienna Arbitration Days, the leading arbitration conference in Austria, took place on 19th and 20th January 2018. The event welcomed participants from numerous jurisdictions around the globe for two days of lively discussion on leading topics in international arbitration. The topic of this year's conference was "Venturing into New Fields and New Ways of Arbitration".

Our associates Miranda Mako and Peter Rižnik have acted as Table Secretaries during the Arbitration World Café on 20th of January, encouraging great discussions on the topics of "International Arbitration vs Artificial Intelligence" (Miranda) and "Awarding Costs in Arbitration: What Works and What Can be Done Better" (Peter).

Austrian Arbitration Academy - Arbitration Rules in Practice,  Winter Program 2018

17th January marks another step in Konrad & Partners’ mission to educate and inspire students and young practitioners to international arbitration as Dr. Christian Konrad held a lecture on “Arbitral Awards” at the Law Faculty of the University of Vienna. The lecture is part of the Winter Program of the renowned Austrian Arbitration Academy.

In his presentation, Dr. Konrad laid specific emphasis on the practical aspects of drafting arbitral awards by sharing his experience both as counsel and as arbitrator. In particular, he underscored the objective to render an award that is enforceable and encouraged future arbitration practitioners to retain this aspect from the very beginning of arbitral proceedings.

Dr. Konrad contributes to the Winter Program of the Austrian Arbitration Academy for the second consecutive year. In 2017, he was joined by Friederike Schäfer who serves as counsel at the International Court of Arbitration of the International Chamber of Commerce. Furthermore, Dr. Konrad regularly teaches at the Summer School of the Austrian Arbitration Academy. 

Arbitrators' Quest - Konrad & Partners'  SEE and CEE mock trial

After three successful editions, Konrad & Partners is pleased to announce the organization of the 4th edition of its “Arbitrators’ Quest – Konrad & Partners´ CEE and SEE mock trial”, which will take place in Vienna on 17 May 2018.

Established in 2015, the Quest provides dedicated students and young professionals with the opportunity to combine their academic skills with practical experience in a mock international arbitration trial, as well as gain insight into and first-hand experience with situations and matters typically arising in international arbitration dispute.

Based on their written and oral performance, the winner will be elected from amongst the participants who will be offered a paid two-month internship with the Konrad & Partners Arbitration Practice Group in Vienna.

The competition is open to students, graduates and young professionals with interest in international arbitration.

What was not discussed at GAR Live Vienna - ArbAut Forum

On 30th of October 2017, the Austrian Arbitration Association jointly with the University of Vienna held its semi-annual ArbAut Forum, with the participation of our partner Philipp A Peters as discussant. The event followed the successful GAR Live Vienna, which had taken place on 20th of October. The Forum aimed at analyzing "What was not discussed at GAR Live Vienna" in a Tylney Hall style discussion of topical issues of international arbitration.

Mr Peters exchanged views with the panelists and the audience on whether new instruments would be required or not in order to ensure the independence and impartiality of party-appointed arbitrators. The panel also discussed the extent to which arbitrators are allowed or even required to guide a party with a view to the burden of proof and the lack or sufficiency of evidence. Following a debate on professional rules and ethics and a lively discussion on whether there exists a need for summary arbitration proceedings, the event was concluded by a rather controversial debate on the apportionment of costs, including the arbitrator's possibility to sanction a party's procedural behavior in their cost decisions. 

GAR Live Vienna

Dr Christian W. Konrad has delivered a speech on the Enforcement of Arbitral Awards on Albania, Kosovo, Macedonia and Slovenia at the inaugural edition of GAR Live Vienna on 20th October 2017. His presentation was part of the panel discussion dedicated to the "Enforcement around the region: How to get the client paid", exploring both the legal and practical aspects of translating recognised awards into real money and moderated by Alice Fremuth-Wolf, Deputy Secretary General, Vienna International Arbitral Centre.

How to Build Trust in Institutional Arbitration

On 11th of October 2017, Dr Christian Konrad had the honor to deliver a speech at the first annual conference organized by the German - Romanian Chamber of Commerce and Industry in Bucharest, Romania. The conference addressed the topic of "How to build trust in institutional arbitration" and brought together Romanian business leaders and lawyers.

In his speech, Dr Konrad focused on arbitration in Austria and Austria as a leading hub of international arbitration in Europe and shared his best practices. 

70th Anniversary of the Permanent Arbitration at the Chamber of Commerce and Industry of Serbia

On 6th of October, our associate Peter Rižnik spoke at the international conference dedicated to the 70th Anniversary of the Permanent Arbitration at the Chamber of Commerce and Industry of Serbia, held in Belgrade.

His presentation focused on the arbitrability of concession disputes in Slovenia, shedding a light on the infamous authentic interpretation of the Slovenian Parliament adopted in 2011. The crux of his presentation was to show that concession disputes in Slovenia remain fully arbitrable, which was confirmed by the Supreme Court.

Annual VIS Moot Reception with the President of the Chartered Institute of Arbitrators

On the occasion of the 24th Annual Willem C. Vis International Commercial Arbitration Moot, Konrad & Partners and the Scottish Arbitration Centre hosted another Moot Reception.

We welcomed more than 100 renowned practitioners from all over the world at our Vienna premises for an informative and enjoyable evening over champagne and canapés. We felt particularly honoured to welcome our guest of honour Dr Nayla Comair-Obeid, President of the Chartered Institute or Arbitrators. We would like to thank everyone who attended our Cocktail and this made this a memorable event.

UNCITRAL-LAC Conference on Dispute Settlement

On 4 April 2017, Dr. Heidrun Halbartschlager sat on a panel at the UNCITRAL-LAC Conference which was jointly organized by UNCITRAL and the Ljubljana Arbitration Center. The conference addressed the topic of “Modern Times for International Arbitration” and took place at the Chamber of Commerce and Industry of Slovenia. 

In her presentation, Heidrun focused on selected aspect of Austrian Arbitration law.

Panel Discussion at Young ICCA Event in Pristina

On 23 February 2017, Dr. Heidrun Halbartschlager sat on the panel of Young ICCA´s conference in Pristina to discuss the topic of Party Representation Costs and Costs of the Arbitration.

In her presentation, Heidrun focused on security for costs orders in international arbitration.

Lecture on arbitration law at Danube University Krems

On 14 – 15 January 2017, Dr. Heidrun Halbartschlager, Dr. Michael Hofstätter and Martin Hackl held all-day lectures on (international) arbitration law at the Danube University of Krems.

On the first day the students were provided with an overview of arbitration law and an insight into the legal foundations of Austrian arbitration. The second day was focused on practical issues and particularities of international arbitration. In addition, various other forms of international dispute resolution were discussed.

Arbitrators’ Quest – Konrad & Partners´ CEE and SEE Mock Trial

We are pleased to announce that after two successful competitions,  the “Arbitrators’ Quest  – Konrad & Partners´ CEE and SEE mock trial based on real life experience” is being convened for the third consecutive year on 12 May 2017 in Vienna.

Since Konrad & Partners is committed to encouraging and fostering future talent, the Quest provides dedicated senior students with the opportunity to combine their academic skills with practical experience in a mock international arbitration. Participants will be guided under the supervision of experienced lawyers and renowned scholars to prepare their written and oral arguments, and to appear before an arbitral tribunal on 12 May 2017 to argue their case.

Based on the written submission (to be submitted in advance of the hearing) and oral performance, an “Arbitration Specialist” will be elected from amongst the participants, who will be offered a paid internship in our Arbitration Practice Group in Vienna.

The Austrian Arbitration Academy is a programme run in cooperation with SHS, VIAC, YAAP and ArbAut and is designed to enhance experienced international arbitration practitioners´ knowledge and expertise. The course will take place in February 2017, and consists of lectures held by first class international arbitration practitioners and participation in the Vienna Arbitration Days, the leading arbitration conference in Austria. Panel discussion: Free Trade Agreements and Arbitration

Konrad & Partners, in cooperation with the WPZ University of St Gallen, will hold a panel discussion on “Free Trade Agreements and Arbitration” on 3 November 2016, at 6:30pm at Österreichische Kontrollbank.

Dr. Christian Konrad (Konrad & Partners) and Prof. Dr. Christian Keuschnigg (University St. Gallen) are the opening speakers, and will be joined by Gottfried Schellmann (Müller-Koch & Schellmann) and Prof. Ursula Kriebaum (University of Vienna).

The panel will be moderarted by Matthias Benz (Neue Zürcher Zeitung).

Conference in Brussels: Energy and arbitration

Dr. Michael Hofstätter shared his experience regarding the compensation for damages in energy disputes at the conference “energy and arbitration”.

On 19 May 2016, the Association for International Arbitration hosted a conference on energy and arbitration in Brussels. Dr. Michael Hofstätter and other esteemed speakers were invited to share their experience, expertise and in-depth knowledge with dispute resolution in the energy sector, particularly in the oil and gas sector.

Dr. Michael Hofstätter discussed the topic “compensation for damages in energy disputes”.

Philosophisches Dinner mit Prof. Köchler

Konrad & Partners veranstaltete einen weiteren Abend rund um die philosophische Debatte über Gerechtigkeit und Macht.

Hans Köchler, Professor an der Universität von Innsbruck und Präsident der International Progress Organisation (IPO), einer nichtstaatlichen Organisation mit Beraterstatus bei den Vereinten Nationen, erlangte internationale Anerkennung als Folge seiner Ernennung zum Beobachter im Lockerbie Prozess durch den Generalsekretär der Vereinten Nationen Kofi Annan im Jahr 1998. Prof.  Köchler verdankt seinen Bekanntheitsgrad ebenfalls seiner Arbeit über das philosophische Fundament internationaler Beziehungen sowie seiner unzähligen Publikationen und Leistungen in der akademischen Forschung. Es war ein sehr anregender Abend mit elegantem Essen, gefolgt von einer inspirierenden Rede und interessanten Diskussionen unter führenden Schiedsrechtsexperten.

Konrad & Partners @ Wien Energie Business Run 2015

Konrad & Partners´ “International Arbitration Team” successfully participated in the 15th Vienna Energy Business Run at Vienna's Ernst-Happel-Stadion.

Under the new record number of 30,000 participants from 1,123 different companies, the runners of the arbitration law firm were able to achieve great results and ran the 4.1 km as a team in a total record time of 1:20:00.

YIAG meets VIS 2015

The topics of the event are “Joining Non-Signatories” and “Interim Relief & the Emergency Arbitrator”. They will be discussed from the perspective of the new 2014 LCIA Rules as well as of this year’s VIS Moot problem.

Juli Austrian Arbitration Academy

Dr. Christian W. Konrad wird, gemeinsam mit anderen renommierten Schiedsrechtsexperten aus Lehre und Praxis, an der diesjährigen Austrian Arbitration Academy unterrichten. Auch dieses Jahr ergriffen zahlreiche hochkarätige Vertreter der internationalen Schiedsgerichtsbarkeit die Gelegenheit, im Zuge des jährlichen Willem C VIS Arbitration Moots beim mittlerweile traditionellen Cocktailempfang von Konrad & Partners zu einem interessanten und informativen Austausch in angenehmer Atmosphäre zusammenzukommen. Für erstklassige musikalische Unterhaltung sorgte Starviolinistin Céline Roschek.

Success

Erstmalig war Konrad & Partners dieses Jahr auf der „Success“- der alljährlich am Wiener Juridicum stattfindenden Karrieremesse für angehende Juristen - vertreten. Zahlreiche interessierte Studierende nutzen die Gelegenheit, sich im persönlichen Gespräch und aus erster Hand über die Herausforderungen und den Arbeitsalltag in einer international tätigen Schiedsrechtskanzlei zu informieren.

Im Zuge der diesjährigen Vienna Arbitration Days, der jährlich stattfinden österreichischen Schiedsrechtskonferenz, referierte Philipp A. Peters zum Thema `Verjährung in Internationalen Schiedsverfahren´. Vor einem hochkarätigen Publikum aus internationalen Schiedsrechtsexperten bot er einen umfassenden Überblick über das Thema, diskutierte die relevanten Aspekte und wies auf bestehende Herausforderungen für Schiedsrichter in diesem Zusammenhang hin.

Philosophischer Abend "Die Jagd nach dem Glück"

Am 16. Jänner 2014 fand sich eine hochkarätige Runde der Juristenbranche bei einem philosophischen Abendessen zur „Jagd nach dem Glück“ in den neuen Kanzleiräumlichkeiten von Konrad & Partners ein.

Kein geringerer Philosoph als der über die Grenzen hinaus bekannte Professor für Philosophie, Dr. Georg Liessmann, führte mit interessanten Sichtweisen und Interpretationen zum Thema Glück durch den Abend. Prof Liessmanns Vortrag stellte dabei den Auftakt eines lebhaften Austauschs unter den Gästen dar.

Botschaft des Philosophen an diesem Abend: Der Mensch lebt dann richtig und kann Glück erfahren, wenn er aus seiner Vernunfteinsicht und mit Hilfe der Vernunft all seine Anlagen und Möglichkeiten optimiert – wenn er sich also als Mensch verwirklichen kann.  Das Glück ist daher keineswegs ein „Vogerl“ wie doch gerne behauptet wird.
